This Privacy Policy & Cookie Notice describes how we (Proxeus Anstalt), collect, use, share and generally process your personal information when you visit https://proxeus.com/ and https://demo.proxeus.com/ (the “Site”).

Personal information we collect or that is collected by third parties on the site

When you visit the Site, certain information about you and your device is automatically collect by using "cookies". “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

YouTube: Our Site has embedded YouTube videos. YouTube is a service provided by Google. YouTube may set a number of cookies on your computer, which result in Google being able to obtain certain personal information from you. Embed.ly: We use Embed.ly to embed certain external content into our Site. Embed.ly tracks user interaction with their embedded content. For further information about the data collected by Embed.ly please consult its Privacy Policy (Link for Embed.ly's Privacy Policy). Place of processing: US.

Additionally, when you sign up for a newsletter through the Site, or register to the demo platform using your e-mail address, we collect your e-mail address. We refer to this information as “Subscription Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both, about Device Information and Subscription Information.

How do we use your personal information?

We use the Subscription Information that we collect generally to communicate with you via the newsletters you have subscribed to or to provide the services requested. The legal basis for sending the newsletter is your consent (art. 6 para. 1 lit. a GDPR). The legal basis for transmission of information and provision of services is their necessity for the performance of a contract to which you are a party or for the implementation of pre-contractual measures which are taken at your request (art. 6 para. 1 lit. b GDPR).

We use the Device Information collected by Google Analytics to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how you browse and interact with the Site, and to assess the success of our marketing and advertising campaigns). The legal basis for this is art. 6 para. 1 lit. f GDPR. Processing is necessary to safeguard our legitimate interests because in this case your interests or fundamental rights and freedoms, which require the protection of personal information, do not prevail.

We also use your Personal Information to further develop our Services, administrate our platform and comply with all legal requirements. The legal basis for this is art. 6 para. 1 lit. c and f GDPR.

Additionally, if you are a European resident we use your Personal Information in order to fulfil contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests. The legal basis is the necessity for the performance of a contract to which you are a party or for the implementation of pre-contractual measures which are taken at your request (art. 6 para. 1 lit. b GDPR) as well as the necessity to safeguard our legitimate interests (art. 6 para. 1 lit. f GDPR).

Sharing your personal information

We share your Personal Information with third parties in order to be able to use your Personal Information, as described above. Such third parties are either in a country which provides for an appropriate data protection from a GDPR perspective or we take the necessary safeguards to ensure that your Personal Information is protected in line with the GDPR requirements.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights (art. 6 para. 1 lit. c, e, f GDPR).

Please be aware that the third party cookie providers as listed above under section "Personal Information we collect or that is collected by third parties on the Site" do directly collect and process your data from our Site. We have no agreements with them and cannot control what they do with your Device Information.

Please note that your Personal Information will be transferred outside of the EEA, including to the United States.

Do not track

Please take note that we do not alter our Site’s data collection and processing practices as set out herein when we see a Do Not Track signal from your browser.

Your rights

In accordance with the data protection laws applicable to you, the following rights may be available to you: The right to (1) ask us for information about and (2) correction or (3) deletion of your Personal Information or (4) limitation of the processing of your Personal Information and (5) to object to the processing of your Personal Information. In addition, you may have (6) the right to data portability as well as (7) a right to lodge a complaint. You have the right at any time to withdraw your consent to the processing of your Personal Information for the future. Be aware that the withdrawal of your consent has only effect for the future (the lawfulness of the processing on the basis of the consent until the withdrawal remains unaffected by the withdrawal).

Data retention

When you sign up for a newsletter through the Site, we will maintain your Subscription Information for our records unless and until you ask us to delete this information.

With regard to other Personal Information, we will maintain the information as long as there is a legal ground to maintain such Personal Information. Change

We may update this Privacy Policy & Cookie Notice from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
